For these activities, Prosper is the controller of your personal information.
1. When We Work for Clients
When we deliver services, clients may share personal information with us, such as employee names, roles, survey and assessment responses, and CRM records. We use that information only to provide the services the client engaged us for. We do not use it for our own marketing, sell it, or use it to develop products or services for anyone else, and we return or delete it at the client's request. The client decides how that information is used, and its privacy notice applies, so please direct questions about it to the client. If you contact us, we will refer your request to the client.

3. How We Use Information
Where the GDPR, UK GDPR, or Swiss data protection law applies, we rely on the legal bases below. Where we rely on legitimate interests, we have balanced them against your rights.
| Purpose | Legal basis |
|---|---|
| Respond to inquiries | Legitimate interests; steps you request before a contract |

| Comply with law and protect our legal rights | Legal obligation; legitimate interests |
Providing information is voluntary, but without it we may not be able to respond to you, enter into a contract, or consider an application.
4. Meetings and Artificial Intelligence
We use AI tools to draft documents, summarize meetings, analyze information, and support client work.
- When we record or transcribe a meeting, the AI notetaker joins the meeting as a visible participant, or the meeting platform displays a recording indicator, so everyone in the meeting can see that it is being recorded. Any participant may object at any time, and we will stop the recording and delete it on request.
- We use business or enterprise versions of AI tools under terms that do not permit the provider to train its models on our data or our clients' data.
- People at Prosper review AI-generated work before we rely on it or deliver it.
5. How We Share Information
We share personal information only with:
- Service providers that work for us under contract, such as website hosting, email and collaboration, CRM, meeting and AI tools, accounting, and IT support, and only to provide services to us;
- Clients, for project communications within an engagement;
- Professional advisors, such as lawyers, accountants, and auditors, under confidentiality obligations;
- Authorities or others where required by law or needed to protect rights, property, or safety;
- A buyer or successor in a merger, acquisition, or sale of our business, subject to this Policy; and
- Others with your consent or at your direction.
6. What We Do Not Do
- We do not sell personal information.
- We do not share personal information for targeted advertising or allow third parties to track Site visitors across websites.
- We do not make decisions based solely on automated processing that have legal or similarly significant effects on you.
- We do not attempt to re-identify de-identified information.
7. Cookies and Analytics
The Site is hosted on Framer, which provides aggregate website analytics. We do not use advertising cookies or trackers. Fonts may load from Google, which receives your IP address to deliver them. Because we do not track visitors across websites, the Site does not respond differently to Do Not Track signals. Where the law treats a Global Privacy Control signal as an opt-out of sale or targeted advertising, we honor it.
8. Marketing
We send marketing emails only where the law permits, including with your consent where required. You can unsubscribe through the link in any email or by writing to privacy@pathtoprosper.io.
9. Retention and Security
We keep personal information only as long as needed for the purposes in this Policy, considering our relationship with you, our contracts, and legal, tax, and accounting requirements, and then delete or de-identify it. We protect information with administrative, technical, and organizational measures, including access controls and encryption in transit. No system is completely secure. If a security incident affects your information, we will notify you and authorities as the law requires.
10. International Transfers
We are based in the United States, and we and our service providers process information in the United States and other countries. Where the law requires safeguards for transfers from the European Economic Area, the United Kingdom, or Switzerland, we put appropriate safeguards in place, such as the European Commission's Standard Contractual Clauses.
11. Your Rights
Depending on where you live and the laws that apply, you may have the right to access, correct, delete, or receive a portable copy of your personal information; to restrict or object to its processing, including for direct marketing; and to withdraw consent at any time. We will not discriminate against you for exercising these rights.
To make a request, email privacy@pathtoprosper.io. We will verify your identity and respond within one month or the period the law requires. An authorized agent may act for you with your written authorization. If we decline your request, you may appeal by replying with "Appeal" in the subject line, and someone not involved in the original decision will respond within 60 days. If you are in the EEA, UK, or Switzerland, you may also complain to your local data protection authority.
12. Children
The Site and our services are intended for businesses and are not directed to children. We do not knowingly collect personal information from anyone under 16, and we will delete any we learn we have collected.
13. Changes
We will post any updates on this page and revise the effective date. For material changes, we will provide additional notice where the law requires.
